피고인은 2014. 3. 12. 22:50경 의정부시 의정부동 태릉숯불갈비 앞 도로에서부터 같은 시 녹양동 녹양역 사거리에 이르기까지 약 100m 가량의 구간에서 혈중 알콜농도 0.252%의 술에 취한 상태로 B 크루즈 승용차량을 운전하였다.
