1. The plaintiff shall dismiss the lawsuit against the defendant National Agricultural Cooperative Federation;
2. The plaintiff's defendant A, B, and Nonghyup Bank.
Reasons
1. Basic facts
A. The Plaintiff’s claim 1) The Plaintiff’s claim against K is the limited-liability company specialized in the next securitization of Korea’s name (hereinafter “Korea’s name borrowed”).
(C) On July 10, 203, after filing a lawsuit against C, etc. on the claim for the amount of the transfer, the Daegu District Court sentenced D and E to the above company for KRW 125,00,000 as well as KRW 21% per annum from August 16, 1997 to December 31, 1997; 35% per annum from the next day to July 12, 1998; 27% per annum from the next day to November 24, 1998; 25% per annum from the next day to April 14, 199; and 23% per annum from the next day to the day of complete payment; and the above decision became final and conclusive on August 23, 2003; and the above decision became final and conclusive on August 24, 2003.
After that, the Plaintiff filed an order with C, etc. to pay part of the above amount as Seoul Central District Court No. 2013 tea 43898, Jun. 27, 2013, for the payment of KRW 20,00,00 with D, E, and the Plaintiff jointly and severally with the Plaintiff, 21% per annum from August 16, 1997 to December 31, 1997; 35% per annum from the next day to July 12, 1998; 27% per annum from the next day to November 24, 1998; 25% per annum from the next day to April 14, 199; and 3% per annum from the next day to the day of complete payment; and the above order to pay was finalized on September 18, 2013.
B. The instant real estate was originally owned by C, and C was completed on August 21, 1989 with respect to the said real estate on August 21, 1989 (hereinafter “instant provisional registration”). The instant real estate was a provisional registration of ownership transfer claim on the ground of trade reservation on August 21, 1989 (hereinafter “instant provisional registration”).
2) Korea District Court 203Kadan4217, Daegu District Court 2003Kadandan4217, which requested provisional seizure against C, and the provisional seizure was ordered on September 16, 2003, and accordingly on the same day.
