Reasons
Punishment of the crime
On April 27, 2014, the Defendant taken a dynamic image with the victim F (70 years of age) who is a victim of E having an internal combustion relationship with the Defendant at the DNA conference located in Jeju, 09:00, and agreed to take a dynamic image with the victim on the condition that the victim and E maintain an internal relationship with the victim, and that the victim and E shall take a dynamic image each month and receive transmission of it, on condition that they shall have an internal relationship with the victim.
1. No person who violates the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. shall repeatedly send any codes, words, sound, image, or motion picture that arouses fear or apprehension to any other person;
Nevertheless, on May 11, 2014, the Defendant sent text messages to the husband to the victim’s cell phone with the victim’s mobile phone, and to the husband’s address, such as pictures and videos with the victim’s sexual intercourse with the victim, and video and the victim’s address, at around 20:08, the Defendant sent text messages.
From around that time to June 27, 2014, the Defendant sent text messages to 15 times in total by the same method from the city of Daegu as indicated in the annexed crime sight table.
Accordingly, the defendant has repeatedly reached the victim's text that arouses fear or apprehension.
2. Around May 18, 2014, the Defendant attempted to proceed to the public by transmitting a text message to the effect that “I would like to have 24 million won or less from a victim of sexual intercourse, taken by the Defendant as above, using the victim’s sexually related video taken by the Defendant and E, and she would have sprinked the victim for 24 million won or less from the victim, so I would like to have sprinked the victim without permission within 6 months, so I would like to see “I would like to see I would like to see I would like to do so, if I would like to see I would like to see I would like to see I would like to go fairly and fairly.” However, I would like to have attempted to get back property from the victim of drinking sprinkage.
