A defendant shall be punished by imprisonment for four months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On December 26, 2016, the Defendant stated that “If the Defendant sent 18K Tran 1 point on a door-to-door basis, he/she would make payment by January 26, 2017, he/she would make payment thereof by no later than January 26, 2017.”
However, the defendant did not have the intention or ability to pay the price even if he received the return from the injured party by door.
Nevertheless, on January 4, 2017, the Defendant: (a) by deceiving the victim as above; (b) issued 18K Twit-ro 18K Twit-ro 1,062 won at the market price from the 31st floor of the Dongjak-gu Seoul Metropolitan Government D Building D on January 4, 2017 to the victim.
2. On December 28, 2016, the Defendant told the victim C to pay the price by January 26, 2017, using the cell phone Kakao Stockholm message using the cell phone text message “if the Defendant sent 2 points of 18 K Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka Ka.”
However, the defendant did not have the intention or ability to pay the price even if he received a return from the injured party by door-to-door delivery.
Nevertheless, on January 11, 2017, the Defendant was issued two points of the 18 K Titd half of the 1,258,975 won at the market price from Gwanak-gu in Seoul Special Metropolitan City E, 302 to the victim by deceiving the victim as above.
3. On January 16, 2017, the Defendant stated that “If the Defendant sent 18 K Ga Ga Kakao message to the said victim C a door-to-door message using a cell phone Kakao Stockholm message, the Defendant would pay the amount by January 26, 2017.”
However, the defendant did not have the intention or ability to pay the price even if he received the return from the injured party by the door-to-door delivery.
Nevertheless, the defendant deceivings the victim as above, and caused damage to it, 18 KK equivalent to the total market value of 1,651,270 won in Gwanak-gu in Seoul Special Metropolitan City E, 302 on January 24, 2017.
