1. The Defendants are jointly and severally liable to the Plaintiff for KRW 3,96,250 out of KRW 43,492,50. From September 11, 2012, and KRW 3,96.
Reasons
1. Basic facts
A. The Plaintiff is a person engaged in a credit business. 2) The Defendants are married couple.
B. The Plaintiff and the Defendants are jointly and severally guaranteed by Defendant C, and the Plaintiff lent KRW 10 million to Defendant B on September 10, 201 under Defendant C’s joint and several sureties (hereinafter “loan”).
() Defendant B agreed from October 10, 201 to May 10, 2013, the following month following the lending date, to pay the principal amount of KRW 500,000,000 and the interest amount of KRW 150,000,000,000 in total on 10 occasions every month. Moreover, the Plaintiff and the Defendants agreed to pay the principal and interest amount of KRW 6,50,000 in installments on 20 occasions. The same applies to each loan (hereinafter the same applies) to the Plaintiff and the Defendants who have agreed to pay the principal and interest on 10,000 on
(2) Accordingly, Defendant B paid 650,000 won to the Plaintiff over 12 times a month from October 10 to September 10, 2012, but failed to pay the Plaintiff thereafter. (2) The Plaintiff, under the joint and several surety of Defendant C, lent KRW 10,000 to Defendant B (hereinafter “B-transfer”) on September 27, 201, and Defendant B, from October 27, 201 to May 27, 2013, the following month, from October 27, 2011 to May 27, 2013, agreed that the principal repayment amounting to KRW 50,000,000,000 as interest payment, and KRW 15,000,000,000,000 to be paid over 20 times on September 27, 2013.
Accordingly, Defendant B paid 650,000 won to the Plaintiff during the 27th day of October 201 to September 27, 2012, respectively, on the 12th day of each month, but failed to pay the Plaintiff thereafter.
3) The Plaintiff, under Defendant C’s joint and several sureties, lent KRW 30 million to Defendant B on March 13, 2012 (hereinafter “third lending”).
Defendant B agreed to pay the principal amount of KRW 1.5 million and the interest amount of KRW 4.55 million in total over 20 times.
Accordingly, Defendant B, from April 13, 2012 to September 13, 2012, shall be KRW 1950,000,000,000 for each of the 13rd day of each month to the Plaintiff.
