A defendant shall be punished by imprisonment for not less than eight months.

Reasons
Punishment of the crime
On December 11, 2014, the Defendant was sentenced to 8 months of imprisonment with prison labor for a violation of the Punishment of Violences, etc. Act (joint intimidation) at Jeju District Court, and 2 years of suspended execution, and the judgment became final and conclusive on December 19, 2014.
Criminal facts
1. Fraud;
A. On January 15, 2014, the Defendant stated that “The victim D, a seller of the second class C, would sell the 2008 Form No. 350,000 won in payment,” through the land owner C, “The Defendant deposited KRW 20.6 million in payment.”
However, even if the victim received money, there was no intention or ability to sell the NAS.
Around January 16, 2014, the Defendant, by deceiving the victim as above, remitted 4 million won from the victim to his wife E’s account (Account Number:F), and acquired 16.6 million won from the above account on February 21, 2014.

However, there was no intention or ability to send a taxi even if he receives down payment from the victim.
The Defendant, by deceiving the victim as above, received 500,000 won from the victim’s account (Account Number:F) in the name of his wife E, and acquired 3.8 million won from the above account on January 24, 2014 and acquired it by defrauded.
2. Around 00:50 on July 13, 2014, the Defendant driven a H vehicle under the influence of alcohol with a blood alcohol concentration of 0.077% at a section of about 300 meters from the Jeju-do Jeju-do roads around Jeju-do Jeju-do, to the front day of Jeju-do-do-dong roads.
