The prosecution of this case against the defendant is dismissed.

1. On April 28, 2017, the Defendant: (a) around 23:20 on April 28, 2017, at DNA singing stores located in Eunpyeong-gu Seoul, Eunpyeong-gu Seoul underground 1st century, used the first victim E (n, 43 years of age) and city expenses; and (b) assaulted the victim’s right eye outside the aforesaid main shop at one time to the right eye of the victim; and (c) assaulted the victim by drinking once.

2. Determination

(a) Crimes of non-violation of intention: Article 260 (1) and (3) of the Criminal Act;

(b) The injured person shall express his/her intention not to punish the accused after the prosecution is instituted;

(c) Judgment dismissing a public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
