1. Basic facts

A. Defendant C and D are married couple, and Defendant B are the father of Defendant C.

Defendant C owned 552m2 in Seongbuk-gu Seoul, and Defendant D owned 496m2 in F, respectively, but decided to newly construct a detached house on each of the above lands around March 2012.

The Plaintiff is an architect who entered into a contract with the Korea Housing Construction Corporation for each of the above land, etc.

B. Around April 2012, Defendant C entered into a new construction contract with the Plaintiff for the construction of a new apartment house of 552 square meters in E, E, 552 square meters, and the down payment of KRW 22,500,000, and the down payment of KRW 22,500,000,000, not later than August 15, 2012. Around April 23, 2012, Defendant C paid KRW 10,000, out of the down payment to the Plaintiff, and around that time, the Plaintiff agreed to newly construct a detached house on the land arising from a divided merger of 52 square meters in E, 52 square meters and the above F, 496 square meters, and the progress of the construction project under the first contract would be postponed.

C. On May 1, 2012, Defendant C and D entered into a building design contract of KRW 5,000,000 with respect to the construction of detached houses over the above E and F land level (hereinafter “second contract”) with the Plaintiff.

On September 17, 2012, a large volume of 203 square meters was divided among the above E-ga 552 square meters, and was divided into 203 square meters in Seongbuk-gu Seoul, Seoul, and a large volume of 147 square meters out of the said F 496 square meters was divided into H large 147 square meters. Defendant B completed the registration procedure for transfer of ownership on September 27, 2012 with respect to the said G large 203 square meters on September 20, 2012, with respect to the said H large 147 square meters on September 27, 2012, and on August 10, 2012.

E. On October 2, 2012, Defendant B entered into a new construction contract (hereinafter “third contract”) with the Plaintiff on October 2, 2012, with regard to the construction of a new house with a size of 203 square meters in the above G G 203 square meters and the above H 147 square meters in quantity, with regard to the construction of a new house with a value of 210,000,000 square meters in the beginning date, around October 2012, and around January 2013 on the completion date.

On October 9, 2012, the above G 203 square meters and the above H 147 square meters shall be located in Seongbuk-gu Seoul Metropolitan Government G.
