Defendant shall be punished by a fine of 5 million won.

If the defendant does not pay the above fine, 500,000 won shall be paid.

Punishment of the crime

The Defendant is the captain who is comprehensively responsible for the operation and fishery activities of the single-sea fishing boat C (5 tons or more) with the single-sea fishing boat of China.

No foreign vessel shall engage in any activity detrimental to peace, public order, or security of the Republic of Korea, such as fishing at the time of passage through the territorial sea of the Republic of Korea.

Nevertheless, at around 21:00 on May 25, 2013, the Defendant boarded five seafarers under the same paragraph, loaded 200 water from the deceased, and departed from the said fishing vessel. At around 15:00 on June 4, 2013, the Defendant captured approximately 20 km and approximately 20 km in one column from the 4.5 nautical miles (N 37°50 minutes North latitude, 124°50 minutes East longitude, and 7.5 nautical miles in territorial sea) north-dong, Incheon Cheongjin-gun, Incheon, on June 4, 2013.

Accordingly, the Defendant engaged in fishing activities within the territorial sea of the Republic of Korea to harm peace, public order or security of the Republic of Korea.
