1. The defendant shall be the plaintiff.
(a) The rate of KRW 37,375,116 and KRW 37,829,859 among them shall be from June 26, 2019 to the date of full payment.
Reasons
1. Facts of recognition;
A. On January 2017, upon the Defendant’s request, who had worked at the same workplace as a patrolman, the Plaintiff entered into an agreement with the Defendant to deposit the loan into the Defendant’s bank account by obtaining a loan from so-called “2 and 3 financial rights,” with the Defendant’s bank account so that the Plaintiff may pay the principal in installments and interest on the principal to the financial institution, and to pay all the loan principal within three months.
B. On January 11, 2017, the Plaintiff received a loan of KRW 21 million at the interest rate of KRW 23.9% per annum from C Co., Ltd. (hereinafter “C”) and KRW 7 million at the interest rate of KRW 27.9% per annum from D Co., Ltd. (hereinafter “D”), ③ interest rate of KRW 18.9% per annum from E Co., Ltd. (hereinafter “E”), interest rate of KRW 20 million per annum 21.9% per annum, ④ interest rate of KRW 18.9% per annum from F Co., Ltd. (hereinafter “F”), interest rate of KRW 10 million per annum 21.9% per annum, and KRW 10 million per annum from 4 financial institutions (hereinafter “Plaintiff’s account”) and deposit account number of KRW 50,000,000 per annum, KRW 5089,507,987,500,000 per annum.
C. On January 13, 2017, the Plaintiff deposited KRW 30,798,500, out of KRW 57,998,50, which was deposited in the Plaintiff’s account, to the Defendant. The first three months paid the installment repayment and interest on the instant financial institution with the loans remaining in the Plaintiff’s account.
On April 17, 2017, the Plaintiff deposited KRW 22,562,697 to the Defendant, and 462,940 out of the borrowed money, left the Plaintiff’s account.
E. Since the Defendant deposited KRW 1 million into the Plaintiff’s account on April 28, 2017, the early payment of the installment and interest was made on a timely basis, and the deposit is delayed after the lapse of time, and the deposit is KRW 1.2 million on January 21, 2019.
