1. The defendant shall be the plaintiff.

A. Of the size of 436 square meters in Namyang-si, E-do, each point of the attached Form 14, 15, 21, 22, and 14 is indicated.

Basic Facts

A. The Plaintiff is the owner of 22m2 (hereinafter “each of the instant lands”) in Namyang-si, Namyang-si, Eandong-si, E, 436m2 and F forest land (hereinafter “each of the instant lands”). The Plaintiff completed the registration of ownership transfer on May 18, 2006 with respect to the said E lands, and on July 29, 2008 with respect to the said F.

B. On each of the above lands, passage roads used by neighboring residents to move to bus stops exist, and the concrete packaging on the above passage roads is not known when the concrete packaging has been implemented, but the defendant, the local government having jurisdiction over the administrative district of the land of this case, is implementing the repair road construction project around October 2002, and the construction project of the raination facilities was also implemented around October 2006.

C. From August 2008, the Plaintiff requested the Defendant to install fences and move roads to protect the Plaintiff’s privacy, and the Defendant, around June 201, constructed a fence between the above passage road and the building owned by the Plaintiff, and moved the passage to the above land.

After the implementation of each of the above construction works, there is a passage on the part (D) of the attached Form 1, which connects each point of 14, 15, 21, 22, and 14 among the 436С in Nam-si, Namyang-si, the Plaintiff owned by the Plaintiff, and the part (D) of the attached Form 2, among the 22С and 223С in the attached Form 2, among the 8, 7, 6, 5, 4, 13, 12, 11, 10, 9, and 8, which connects each point of 32 square meters in sequence.

F. The Plaintiff filed a civil petition against the head of the G Administrative Welfare Center for requesting the relocation of a passage route and the reconstruction of a fence. On July 6, 2016, the Ombudsman Committee for Namyang-si filed a petition with the head of the G Administrative Welfare Center.
