A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On June 13, 2018, the Defendant discovered one of the Samsung Credit Card lost by the victim C in the first floor outdoor resting room located under the control of Nam-gu Incheon Metropolitan City, Nam-gu, Seoul, and stolen it by using the gaps of the on-site manager’s care.

2. On June 14, 2018, around 00:09, the Defendant used a computer, etc., to pay KRW 10,000 of the PC by using the victim’s Samsung Credit Card, which was stolen as set forth in paragraph 1, from around 00:09 to around 02:31:44 of the same day, as shown in the list of crimes committed in Annex D, with a total of KRW 48,300,00 from around five occasions, as the card was stolen by using the victim’s Samsung Credit Card, as described in paragraph 1.

Accordingly, the defendant has taken property benefits by inputting and processing information without authority in a computer or any other information processing device.

3. Fraud;

A. The Defendant, around June 14, 2018, presented the stolen Samsung Credit Card to an employee of convenience stores as stated in paragraph (1) when purchasing goods at the “F convenience store operated by the victim due to the unsound name in Nam-gu Incheon Metropolitan City E” around 00:21:01, and had the employee settle 13,500 won, thereby having the employee acquire property profits equivalent to that amount.

B. On June 14, 2018, at around 00:21:48, the Defendant presented Samsung Credit Card to an employee in the same manner as Paragraph 3(a) at the convenience store as described in paragraph 3(a) of the same Article, and had an employee settle KRW 23,000, thereby acquiring pecuniary benefits equivalent to that amount.

4. The Defendant violated the Act on Financial Business Specializing in Credit Industry, as set forth in paragraphs (2) and (3), illegally used Samsung Credit Card Co-ownership, which was stolen as set forth in paragraph (1), on seven occasions in total.
