A defendant shall be punished by imprisonment with prison labor for twelve years.

Punishment of the crime

On October 15, 199, the Defendant was sentenced to three years and six months of imprisonment for special robbery at the Seoul High Court, and the execution of the sentence was terminated on October 2, 2002. On August 19, 2016, the Defendant was sentenced to a suspended sentence of two years and six months and the judgment was finalized on August 27, 2016.

1. 피고인은 2003. 7. 3. 03:00 경 서울 강남구 D에 있는 건물 ××× 호 피해자 E( 여, 당시 24세) 의 집 앞에 이르러 마스크를 착용한 채 2 층 창문을 통해 침입한 다음 샤워를 하기 위해 옷을 벗고 있는 피해자의 목에 미리 준비한 흉기인 칼을 들이대며 “ 눈을 가리고 나를 보지 마라.” 고 위협하여 피해자로 하여금 두 손으로 눈을 가리게 한 뒤 칼로 방 안에 있던 침대 시트를 찢어 찢은 침대 시트로 피해자의 눈을 가리고 입을 막고 양손을 앞으로 모아 묶어 침대에 눕게 하여 반항을 억압한 다음 방안에 있던 피해자 소유의 현금 3만 원과 우리은행 직불카드 1 장을 빼앗아 이를 강취하고, 피해자의 입술에 입을 맞추고 피해자의 가슴과 음부를 혀로 핥은 다음 피고인의 성기를 피해자의 음부에 삽입하여 피해자를 강간하였다.
