피고인과 C는 형제지간인바, C는 1993년경부터 토목건축공사업 등을 목적사업으로 하는 피해자인 주식회사 D, E 주식회사, F 주식회사 등 7개 회사(이하 ‘G’이라 한다)를 설립하여 2008. 11.경까지 G의 대표이사겸 그룹 회장인 대표자로서 업무집행 및 자금관리 등을 총괄하는 업무를 담당하였고, 피고인은 2001. 10. 4.경부터 2008. 6. 16.경까지 G 회사들 중의 하나인 대전 대덕구 H에 있는 I 주식회사의 대표이사 및 G 전체의 부사장으로 G 전체의 입찰 및 대외업무 등을 담당하면서 2008. 11. 4.경 G의 부도 이후 위 G 관련 회사 중 하나인 J 주식회사의 회생관련 업무를 담당하였다.
