A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On December 11, 2007, the Defendant was issued a summary order of KRW 5 million due to a violation of the Road Traffic Act (driving) in the Busan District Court’s branch court, and on May 3, 2011, the Defendant was sentenced to six months of imprisonment with prison labor for the same crime, etc. at the Busan District Court. On November 4, 2015, the Defendant was issued a summary order of KRW 8 million at the Seoul Northern District Court as the same crime.

1. On May 16, 2016, the Defendant acquired one driver’s license of a motor vehicle that the victim D lost at the front parking lot of a restaurant located in Dobong-gu Seoul Metropolitan Government.

The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

2. Around 07:05 on June 1, 2016, the Defendant driven Eone Star Cornex under the influence of alcohol leveling 0.168% without obtaining a driver’s license from the front of Korea Hospital located in the Southern-gu Busan Metropolitan City, to the Hyundai Motor Vehicle located in the same Dong-dong.

3. The Defendant was found to have driven a motor vehicle while driving the motor vehicle at a time and place as set forth in paragraph (2) and was asked to produce a driver’s license from G and H to the F District G belonging to the Busan Southern Police Station.

The defendant presented D's first class driver's license in the name of the director of Seoul Police Agency, which is a public document embezzled and held as in paragraph 1, as if he was the defendant's driver's license.

Accordingly, the defendant did not use official documents.

4. Forgery of private documents and the display of private documents;
