1. The premise is that ① C Forest land 13,997 square meters (hereinafter “the instant forest”) was owned by the network I. As the network I died on October 27, 1979, the Defendant (Appointed Party) and the designated parties (hereinafter “the Defendant”) inherited the said forest land as shares in the attached Table 2.

② The Plaintiff is the wife of the deceased KK (Death on October 29, 1982) who was a dead body in the fourth half of the deceased J (Death on October 17, 1991).

2. 원고의 주장 원고의 시아버지인 망 J는 1967. 12. 31. 이 사건 임야 중 355평을 매수하여 별지1 도면 표시 ㄴ¹, ㄷ¹ ~ ㅅ¹, ㅇ¹, ㅇ², ㅈ², ㅊ², ㄴ¹의 각 점을 순차로 연결한 선내 ‘나’부분 1,849㎡(이하 ‘이 사건 토지 부분’이라 한다)을 경작하다가 1974. 6.경 새로 혼인을 한 막내아들 망 K에게 증여하였고, 망 K는 그 때부터 원고와 이 사건 토지부분을 점유하다가 1982. 12. 29. 사망하였고, 원고는 그 때부터 현재까지 이 사건 토지 부분을 점유하였다.

As above, from December 31, 1967 when the Plaintiff acquired possession of the instant parcel of land and the Plaintiff commenced possession (or from June 1974, 1974, the part of the instant land was donated to the Plaintiff, or from December 29, 1982, or from October 17, 1991, the Plaintiff succeeded to the Plaintiff’s possession due to the Plaintiff’s death of the network K, or from October 17, 1991, as the Plaintiff acquired possession of the instant parcel of land for twenty (20) years, acquisition by prescription for the instant part of land was completed.

Therefore, the Defendants are obligated to implement the procedure for the registration of ownership transfer to the part of the instant land, and where the execution of the procedure for the registration of ownership transfer is impossible due to the expropriation of the instant forest land, among the compensation of KRW 652,027,050 for the instant forest land.
