A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Criminal facts
[Majority Opinion] On September 29, 2016, the Defendant was sentenced to imprisonment with prison labor for three years due to a violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) at the Seoul High Court on September 29, 2016, and the said judgment was finalized on December 29, 2016.
