피고인은 2012. 4. 26. 12:34경 성남시 수정구 B에 있는 C시장 입구 피해자 D(44세, 여)가 운영하는 과일상점 앞길에서 위험한 물건인 식칼(날길이 20.5cm)을 손에 쥐고 길을 배회하던 중 갑자기 위 D를 향해 식칼을 쥔 채로 마치 피해자의 신체에 어떠한 위해를 가할 듯한 태도로 찌를 듯이 달려들어 피해자를 협박하였다.
