1. The Defendants jointly and severally pay to the Plaintiff KRW 217,909,871 and KRW 210,326,406, among them, from May 10, 2014.
Reasons
Comprehensively taking account of the purport of each statement in Gap evidence 1 and 6 (including the number of each number), C was loaned from the plaintiff on May 30, 2012 at the rate of 48 million won per month of repayment, interest rate of 12.5% per annum, interest rate of 25% per annum, interest rate of 30 million won per month of repayment, interest rate of 25% per annum, interest rate of 30 million won per annum, interest rate of 30 million won per annum, interest rate of 5% per annum, interest rate of redemption rate of 3 months, repayment rate of 51 months after the last three months, repayment method of 51 months after the last three months, 7,93,99 won, 18 through 21,190 won, 2,190,000 won, and the defendants were jointly and severally guaranteed, and the above loan contract was terminated by the plaintiff's declaration of intention of termination for reasons of delinquency in the principal, 396, 1996 won, 296
The Defendants asserted that Defendant B lent the name to Defendant A, the actual representative of Defendant A Co., Ltd., but according to each of the evidence Nos. 3 and No. 4-7, as long as Defendant B is recognized as the representative director of Defendant A Co., Ltd. and the joint and several surety of the above loan contract, the Defendants are without merit.
Therefore, the defendants are jointly and severally liable to pay to the plaintiff 217,909,871 won (i.e., 11,626,439 won interest rate of KRW 952,671 won with interest rate of KRW 4,321,59 won with interest rate of KRW 198,69,699,967 for delay payment of KRW 1,986,999), and 210,326,406 won with interest rate of KRW 25% with interest rate of KRW 11,626,439 with interest rate of KRW 4,671 with interest rate of KRW 952,67 with interest rate of KRW 4,679 with interest rate of KRW 198,69,967 with interest rate of KRW 25% from May 10, 2014.
Therefore, the plaintiff's claim against the defendants is accepted on the ground of the reasons.
