A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around November 23, 2018, the Defendant violated the Road Traffic Act (unlicensed driving) driving at a section of about 800 meters from the front road in Ansan-si, Masan-si to the front road in front of the former C at approximately 2,00 meters from the front road in front of the former C, without a driver’s license.

2. 도로교통법위반(음주측정거부) 피고인은 2018. 11. 3. 23:23경 술에 취한 상태로 안산시 상록구 B 앞 도로에서, D 포터 화물차를 운전하다가 위 도로에 주차한 후 운전석에서 잠이 들었고, 112신고를 받고 출동한 안산상록경찰서 E파출소 소속 순경 F으로부터 피의자에게서 술 냄새가 심하게 나고 비틀거리며 얼굴에 홍조를 띠는 등 술에 취한 상태에서 운전하였다고 인정할 만한 상당한 이유가 있어, 같은 날 23:47경부터 약 20분 동안 3회에 걸쳐 음주측정기에 입김을 불어 넣는 방법으로 음주측정에 응할 것을 요구받았음에도, 입김을 불어넣는 시늉만 하는 방법으로 이를 회피하여, 정당한 사유 없이, 경찰공무원의 음주측정요구에 응하지 아니하였다.
