Punishment of the crime

Defendant

A is the representative of the J in which I (hereinafter referred to as “I”) designated 8 number as an intermediate wholesaler at the place of origin and participates in the auction of I fishery products. Defendant B is the representative of K in which I is designated 1 as an intermediate wholesaler at the place of origin 15 and participates in the auction of I fishery products at the place of origin. Defendant C is the representative of L who is designated from I to participate in the auction of I fishery products at the place of origin 20 number, and Defendant D is the representative of M who participates in the auction of I fishery products at the place of origin 22 number.

E and F are certified auctioneers belonging to I in charge of auction at the I fishery products auction house at the I fishery products auction house, and Defendant G and H are stenographys belonging to I in charge of stenographic work on the result of auction at the I fishery products auction house at the I fishery products auction house.

No fishery products shall be traded among intermediate wholesalers at the place of origin except for cases permitted by the head of a Si/Gun/Gu, such as handling overproduction fishery products, as prescribed by Ordinance of the Ministry of Oceans and Fisheries.

1. Defendant A was awarded a successful bid of 18 boxes (108,000 won per box) by participating in an auction at the I fishery products auction house at the place of origin on January 2, 2017.

After that, Defendant A traded fishery products between the intermediate wholesalers at the place of origin by receiving a request from D for trading the fishery products at issue and accepting such request, and selling the fishery products to D.

In addition, from January 2, 2017 to August 3, 2017, Defendant A traded the fishery products worth KRW 233,353,000 in total on 57 occasions as indicated in the annexed crime list (1) in the same manner.

2. Defendant B participated in the auction of the I fishery products at the place of origin on February 1, 2017 and was awarded the bid for the Red Sea 21 Boxes (370,000 won per box) at the I fishery products auction house, and immediately thereafter, Defendant B traded fishery products between the intermediate wholesalers at the place of origin by requesting C to trade the said fishery products, upon purchasing the said fishery products from C.

In addition, Defendant B is in the same way from February 1, 2017 to September 1, 2017.
