Reasons
Details of the disposition
The plaintiff is a soldier (grade) who was dispatched to the military finance division B of the military finance management unit contract.
On April 13, 2020, the defendant issued a reprimand against the plaintiff on the ground that he has breached his duty to maintain dignity (other) and has breached his duty to maintain good faith (abrupting act).
On April 24, 2020, the Plaintiff filed an appeal against the above reprimand, and on April 24, 2020, filed a request against the Defendant for disclosure of the entire disciplinary records (including a list, but excluding the contents related to personal information of the statementer, such as name, resident registration number, address, telephone number, etc.)
The Defendant permitted the disclosure of some information on May 8, 2020, and issued a disposition rejecting the disclosure of information on the following grounds for each information listed in the attached list (hereinafter “instant disposition”). The Plaintiff and the reference witnesses are currently working together, and there is concern that each reference witness may infringe upon his privacy and cause secondary damage to each reference witness, each reference witness may request in writing the disclosure of the relevant information, and the Plaintiff may peruse and copy the confidential information by the decision of the Appeal Commission in the future. On May 14, 2020, the Plaintiff transferred from the Armed Forces Finance Division to another unit, and on June 15, 2020, requested the Defendant to disclose each information listed in the attached list again.
On June 26, 2020, the Defendant took measures to disclose each information listed in the separate sheet to the Plaintiff (Provided, That the information subject to non-disclosure was added to “grades” which the Plaintiff did not specify). The Defendant submitted each of the above information in the instant lawsuit as evidence (Evidence B Nos. 5, 7, 8, 10, 12, and 14) (Evidence B) / [founded grounds for recognition] without dispute, the Defendant’s judgment as to Gap’s evidence Nos. 1, 2, and 3, and evidence Nos. 1, 1, 3, and 1, and the Defendant’s defense prior to the entire pleadings.
