A defendant shall be punished by imprisonment for two years.
Reasons
Punishment of the crime
[criminal history] On September 19, 2007, the Defendant was sentenced to six months of imprisonment with prison labor and two years of suspension of execution for larceny of night buildings in the Goyang Branch of the Jung-gu District Court on September 19, 2007; on March 26, 2009, the Defendant was sentenced to one year and six months of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Central District Court on March 26, 2009; on June 17, 2015, the Defendant was sentenced to one year of imprisonment with prison labor for habitual larceny and completed the execution of the sentence on June 17, 2015.
[Criminal facts]
1. The Defendant committed the crime in C habitually around March 6, 2016: (a) committed the crime in Gwangju, Seo-gu, Gwangju; (b) committed the crime in the following manner: (c) the gap between the employees’ surveillance neglected; (d) the victim’s market price equivalent to KRW 5,400 in total, 3 books and one CD “E” prepared in advance, including “all three types of frauds” in the victim’s market price; and (d) committed the crime in the following manner until October 7, 2016: (a) committed the crime in the following manner: (a) committed the crime in C: (a) committed the crime in KRW 1,806,200, total market price, such as the books owned by the said victim, etc. over 33 times, including the list 1,806,200, supra.
2. The Defendant habitually committed the crime in F around March 9, 2016, at F located in Gwangju-gu, Gwangju-gu, the gap in the employee surveillance neglected, and the Defendant came out in a bank prepared in advance one of the 19,900 won of the market price owned by the victim F, and then stolen, from that time until July 20, 2016, the sum of 70,380 won of the market price, such as the bank owned by the said victim, was 15 times as shown in attached Table 2.
3. On April 29, 2016, the Defendant habitually committed the crime at H around 06:00, the victim K was placed in a locking place in front of the J film Center entrance located in Y-gu Seoul Special Metropolitan City, and the victim K was cut off with a 430,000,000,000 won of the market price of the Plaintiff’s ownership at KRW 230,000,000 of the market price.
