Reasons
Punishment of the crime
1. On April 19, 2012, the criminal defendant against the victim B made a false statement to the victim B that “If the panel is transported from the D Company located in Daegu Seo-gu C to the construction site located in Gyeongnam-gu, the defendant would deposit KRW 200,000 on his own.”
However, the Defendant was unable to pay KRW 300,000, F’s wages and retirement allowances, and KRW 150,000,000. G did not pay KRW 924,00,00 for electrical construction costs, and KRW 100,00 for transportation costs. He was liable for the Defendant’s credit rating of KRW 5,742,00 for the Defendant’s loan, while the Defendant did not have any intent or ability to pay the freight due to the lack of property under the name of the Defendant.
The defendant was provided with the service of transporting the panel from the victim.
Accordingly, the defendant, by deceiving the victim, obtained economic benefits by being provided with the services of the panel equivalent to the market value of 200,000 won.
2. On July 16, 2012, the Defendant made a false statement to the victim I, “K Company” operated by the victim I in the Seo-gu, Daegu-gu, Seoul-gu, stating that “The payment will be made immediately after the delivery of steel materials, which are building materials, to the victim.”
However, in fact, the Defendant was unable to pay KRW 924,00,000, F’s wage of KRW 150,000,00 for E’s wages and retirement allowances. G did not pay KRW 110,000 for the transportation cost of electrical construction cost of KRW 924,00,00 for H, and KRW 10,00 for L Manpower Corporation. He did not pay KRW 5,742,00 for L resource Corporation, and the Defendant was liable for KRW 5,742,00 for the credit rating of KRW 10 for the Defendant’s credit rating of KRW 10,00 for lack of property under the name of the Defendant.
The Defendant was supplied with building materials equivalent to KRW 23,487,726 on three occasions from around that time to February 23 of the same month by the victim.
