Punishment of the crime

No person shall allow another person to deliver words, sounds, letters, pictures, images, or other things that may cause a sense of sexual shame or aversion by telephone, mail, computer, or other means of communication, with intent to arouse or satisfy his/her own or another person's sexual desire.

피고인은 2014. 7. 18. 21:18경 광주 북구 C아파트, 119동 1601호 피고인의 주거지에서 성적욕망을 유발하거나 만족시킬 목적으로 피고인의 휴대전화 어플인 '카카오톡'을 이용하여 피해자 D(여, 19세)의 휴대전화의 카카오톡에 접속한 다음 피해자에게 "니 혀놀림 그립다, 끈풀고 가슴 만져달라, 또해줘봐, 내좆흔들면서 존나신음내봐 ㅋㅋㅋ잘내더만, 너 원룸건물에 사진보내주까, 아님 페북니꺼 찻앗는디 공유해주까'라는 내용의 메세지를 보낸 것을 비롯하여 그때부터 같은 달 20. 14:35경까지 수회에 걸쳐 성적 수치심을 일으키는 내용의 메세지를 보내 상대방인 피해자에게 도달하게 하였다.
