1. The Plaintiff:
A. Defendant SPT Co., Ltd.: KRW 112,462,461 and its amount from May 11, 2012 to May 201, 2014.
Reasons
1. The following facts do not conflict between the parties, or can be acknowledged in full view of Gap evidence 1 to 2-6, Gap evidence 4 to 6, Gap evidence 8, Gap evidence 13 to 14-3, Eul evidence 2-1 to 4-8, Eul evidence 1 to 4, Eul evidence 1 to 4, Eul evidence 6, and the whole purport of arguments.
The plaintiff (formerly: Hanra Construction Co., Ltd.) was ordered by the Korea Highway Corporation to “the 451 line Doz. 451 line expansion works (No. 1 section)”, and held the site site conference on June 5, 2008 in order to select subcontractors of soundproof walls installation works (hereinafter “instant construction works”) among the above construction works, and the same month.
9. The tender for the instant construction project was conducted, and the result of the tender, the Defendant International Metal Co., Ltd. (hereinafter “Defendant International Metal”) was selected as one of the instant construction works, and the Defendant Water-type Industrial Development Co., Ltd. (hereinafter “Defendant Water-type Industrial Development”) as two of the instant construction works, and the Defendant Crod Co., Ltd. (hereinafter “Defendant Crod”) as five of the instant construction works.
Article 3 (Construction, etc.) (1) of the terms and conditions of the subcontract agreement of construction works (hereinafter referred to as "A" in this paragraph) (1) (hereinafter referred to as "B" in this paragraph) shall perform construction works in accordance with the terms and conditions of this contract and design documents (including construction specifications, design drawings and site descriptions: Provided, That in the case of the total unit price contract, the calculation sheets shall be included, and the form of the Rules on Accounting of the Ministry of Finance and Economy shall apply mutatis mutandis to the form; hereinafter the same shall apply).
Article 12 (Inspection of Construction Materials) (1) The materials to be used for the Corporation shall be new materials, and their quality, name, etc. shall conform with the design documents.
However, the quality, name, etc. of goods are not clearly defined in the design documents.
