1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Facts of recognition;
A. The Plaintiff served as a representative director of the Defendant Company from August 22, 2007 to October 15, 2017.
B. In 2007, the Plaintiff entered into a labor contract with the Defendant to receive monthly wage of KRW 1,500,000 (including basic wage of KRW 1,00,000,000, overtime work allowances of KRW 500,000) and performance bonus (which shall be paid according to the payment rate according to the Defendant’s business performance, and shall be paid differently depending on the Plaintiff’s personnel status and result).
C. Around June 1, 2016, the Plaintiff and the Defendant newly signed an employment contract [No. 1, the Plaintiff asserted that the above employment contract was forged, but according to the appraiser C’s written appraisal result, the authenticity of the entire document is presumed to be established. The Plaintiff’s assertion that the appraiser’s appraisal result cannot be trusted. However, the appraiser’s assertion that the above writing and the Plaintiff’s pen and the Plaintiff’s pen are identical with the overall characteristics and condition taken from a self-written test, and that the detailed characteristics (such as the direction of writing, plucking form, length, relative location, distance, and unit of pen) taken into account that the overall characteristics of each letter are identical from D and E, and that the above writing and the Plaintiff’s pen are presumed the same inevitably, and that the appraisal method and appraisal method by the appraiser’s analysis as above are not obviously contradictory or unreasonable, and thus, the Plaintiff’s assertion that the appraisal method and appraisal are not acceptable is not acceptable as follows.
