Defendant shall be punished by a fine of three million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant, a person without a certain occupation, is a person who used the relevant website by signing a notice at “htp” on the website (htp:/www.com) and inserting comments or writing comments on the bulletin.

When the Defendant was aware of the fact on April 13, 201 that a candidate, who was going to the election of the 19th President, through Internet news search, visited F in E on April 13, 2015, and visited F in E in order to use the same to put up a notice of D candidate’s birth place C, when the Defendant came to know that a person who was going to the 19th President election through Internet news search, became aware of the fact that he visited F in E on April 13, 2015.

No person shall publish any false fact with respect to a candidate, his/her spouse, lineal ascendants or descendants, brothers or sisters, or carry any false propaganda document with the intention of distributing any false fact, in order to be unfavorable to the candidate by means of a speech, broadcast, newspaper, communication, magazine, poster, propaganda document, or any other means, with the intention of preventing him/her from being elected.

Nevertheless, at around 12:45 on April 17, 2017, the Defendant, at the Defendant’s house located in Dongdaemun-gu Seoul Metropolitan Government H Apartment apartment 2003, visited the “B” account at the “daily” site for the purpose of preventing the winning of the candidate who was candidate for the 19th presidential election, and, under the title of “I”, opened G under the title of “I”. The Defendant visited the F on April 11, 2017, two photographs and parts of the articles (Seoul Party D’s constituency located in Gwangju Party, PP, Large City Party Members, Qgu Party Members, and 40 persons visiting the election district, including those located in the 11th National Assembly, Gwangju Party Do Council Members, Seoul City Party Members, and 40 persons visiting the election district on April 11, 2015.
