Reasons
Punishment of the crime
1. Joint criminal conduct by Defendant A and Defendant B
A. On June 13, 2020, the Defendants, at around 20:00 on June 13, 2020, carried out drinking in the vicinity of the Bupyeong-gu Incheon, Bupyeong-gu, Incheon, with each other “one-time defect.” On June 13, 202, the Defendants got off the F apartment first floor parking lot near the above address.
The Defendants, with the knowledge of the fact that there are many cases of parking without correcting the door of a vehicle that is not in contact with the victim through the experience of the so-called "hym" crime, the Defendants: (a) opened the door of the vehicle that is not in contact with the victim in the above parking lot, and discovered the HWz car, which is the victim G owners, and entered it, and (b) carried out with the 150,000 won of the market price in contact heading, 150,000 won of cash, 2C card, and 150,000 won of the corporate bank, 2C card.
As a result, the defendants stolen the property owned by the victim jointly.
B. On June 13, 2020, the Defendants, who attempted to commit fraud, stolen G’s property as described in the above paragraph (a) and purchased the clothing equivalent to KRW 75,000 as he moved to J clothes sales outlet located in Bupyeong-si, Busan on June 13, 2020. Defendant B attempted to pay the price by presenting the completion of G’s BC card that was stolen to the employees of the above sales outlet on his name, but before that, G failed to pay the price by presenting it as her own.
Accordingly, the Defendants conspired to acquire property benefits by deceiving the victim, but attempted to commit an attempted crime.
C. On September 29, 2020, Defendants of special larceny (i.e., Sept. 29, 2020) colored a vehicle at the second floor parking lot of F apartment apartment as indicated in the above paragraph (a) at the second floor above the above method, and found a LMW car worth worth KRW 13 million at the market price owned by the victim K, which is parked without correcting the door.
