Reasons
Punishment of the crime
1. Fraud;
A. On December 15, 2010, the Defendant made a false statement to the effect that “If the Defendant lends KRW 2 million to the victim C, he/she would make a payment without molding until February 15, 2011.”
However, in fact, there was no intention or ability to repay the borrowed money.
The Defendant, by deceiving the victim as such, obtained 1,90,00 won, excluding the interest of the victim, from the victim.
B. On December 30, 2010, the Defendant: “Around December 30, 2010, the Defendant borrowed KRW 10 million to the victim without any molding it until March 30, 2011. If the Defendant fails to pay it, the Defendant made a false statement, stating that “A lease deposit to E is KRW 20,000,000,000,000.”
However, there was no intention or ability to repay money, and there was no fact that 20,000 won was paid to E.
The Defendant, by deceiving the victim as such, received 7 million won, excluding the repayment amount for the borrowed money as stated in the “A” and “A” from the victim.
C. On January 14, 2011, the Defendant made a false statement that “The Defendant would make repayment without molding until March 30, 201, including money borrowed from the victim before lending KRW 10 million to the victim” at the above restaurant.
However, there was no intention or ability to repay even if money is borrowed.
As such, the Defendant, by deceiving the victim, obtained 9 million won, excluding the prior interest, from the victim.
2. On February 8, 2011, the Defendant who forged a private document or falsified investigation document is required by the victim to produce the real estate lease contract stated in Section 1.B., and on February 8, 201, with the aim of exercising the request from the victim to produce the real estate lease contract stated in Section 301, “G 24 square meters, Jeonse (Deposit) in the indication of the real estate in the land for the real estate lease contract printed by using the verification color pen in Section 301 of the F building B: KRW 24,00,000,000 per day (temporary payment).”
