1. Each gift agreement entered into on July 15, 201 with respect to each real estate listed in the separate sheet between C and D shall be revoked.
Reasons
1. Presumed facts
A. Under the circumstances where the Plaintiff loaned 2.15 billion won to C several times from May 2005 to October 2005, the Plaintiff borrowed 2.15 billion won to C, and the said loan was not repaid, the Plaintiff received a written statement from C that the amount of loan claims, including interest on each of the above loans, including KRW 10 million, including KRW 3.6 billion, was additionally lent around August 18, 2010.
B. On July 15, 2010, C entered into a contract of donation with respect to each real estate of this case with D, and entered into a contract of donation with the effect that each real estate listed in the separate sheet (hereinafter “each real estate of this case”) is donated to D (hereinafter “instant donation contract”). As to each real estate of this case, the Suwon District Court, Suwon District Court, Port Office, and Port Office of 10582 received on July 22, 2010, and completed the registration of ownership transfer under D’s name.
C. (1) Meanwhile, in addition to each of the instant real property, C owned approximately 28 parcels of land, including the land of the land of the wife E in Permitted-si, and as to each of the said parcels of land, the registration of creation of a neighboring mortgage equivalent to the sum of 4.7 billion won was completed.
(2) In such circumstances, C, on July 201, immediately before the conclusion of the instant gift contract, donated approximately 20 parcels of land to F and G (D’s spouse), which was located in the first place around July 2010, and accordingly, C, after the conclusion of the instant gift contract, was only five parcels of land (50 million won, the publicly announced land price was approximately 648 square meters), including the land of e.g., the e., the land of which was located in C.
As of July 21, 2010, the Defendant entered into a sales contract with D to purchase each of the instant real estate from D with the purchase price of KRW 800 million, and completed the registration of ownership transfer under the name of the Defendant as of July 22, 2010 with respect to each of the instant real estate as the receipt of the Suwon District Court Port Office No. 100583 on July 22, 2010.
