A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. Around October 6, 2014, the Defendant entered into a sales contract with the victim E with regard to the 162 square meters of land and its 50.08 square meters of land located in Jeju, the Defendant, at the C Licensed Real Estate Agent Office located in Jeju, as the Defendant owned.
The Defendant received the down payment of KRW 5 million on the date of the contract with the victim, and the intermediate payment of KRW 5 million on the 7th of the same month, respectively, and agreed on the 22th of the same month to provide documents necessary for the registration of transfer of ownership on the above site and housing, and to receive the remainder of KRW 30 million.
Pursuant to the agreement, the defendant received five million won of down payment from the victim to the Daegu Bank Account (F) account under the name of the defendant, and the same month.
7. The intermediate payment of KRW 5 million was remitted to the above account in the name of the defendant, and upon the defendant's request, the amount of KRW 10,500,000 won on the 13th of the same month, KRW 1.5 million on the 16th of the same month, KRW 4 million on the 16th of the same month, and KRW 1,000,000 on the 27th of the same month was remitted to the above account in the name of the defendant. Nevertheless, around October 30, 2014, the Defendant sold the above site and house to G in violation of the above duties, and completed the registration of ownership transfer for G with respect to the above site and house in Seopo-si, Seopo-si, Seopo-si, Seopo-si, Seopo-si, Seopo-si, 8690 on the following day.
Accordingly, the defendant acquired property benefits equivalent to the value of the above site and the house in the amount, and suffered loss equivalent to the value of the victim.
2. The Defendant, at around October 27, 2014, concluded a sales contract to sell the land and housing owned by the Defendant to the victim Jejun Development Co., Ltd. at the I Licensed Real Estate Agent Office located in Jeju H to KRW 58 million. The Defendant’s agent is the victim’s company.
