A defendant shall be punished by imprisonment for not less than one year and six months.

An application for compensation by an applicant for compensation shall be dismissed.

Punishment of the crime

1. A violation of the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) against the victim D is the actual operator of the E Co., Ltd. (hereinafter “E”), a mutual change and change before November 27, 2007.

On February 18, 2008, the Defendant instructed H and branching I, a representative director in the name of E, at the office of Geumcheon-gu Seoul Metropolitan Government Victim D Co., Ltd., Ltd., and ordered them to enter into a sales contract with the victim to purchase the amount of 623,70,000 Won (231,000 won per single unit).

The Defendant transferred KRW 100,000 to the victim by means of sponsoring for the same day as the purchase price, and via H and I, delivered one promissory note (bill number: J) with a face value of KRW 300,000,000 (bill number: K) and one promissory note (bill number: K) with a face value of KRW 223,70,000,000, to the victim, and received 270,000 from the victim through H and I.

However, from the beginning, the Defendant thought that he would acquire economic benefits by selling and disposing of the said dynasium at salt price, and there was no intention or ability to settle two copies of the said promissory note.

As a result, the Defendant, through H and I on February 18, 2008, by deceiving the victim through H and I, acquired the amount of KRW 2,700 (623,700,000) owned by the victim.

2. The criminal defendant against the victim C is the actual operator of E, and L is the representative director of M Co., Ltd. (hereinafter “M”), and the defendant is a person who actually operated the above M with L. A.

On January 8, 2008, the Defendant, using two promissory notes of the Defendant, issued one copy of the promissory note in the N E office located at Sung-si on January 8, 2008, stating that “The issuer: H representative director E, the face value of 36,000,000, the date of issuance: January 4, 2008; the date of payment: April 30, 2008; the place of payment; and the place of payment: the Bank of Korea's Twittan Branch; the number of bills:O.”
