Reasons
Punishment of the crime
1. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury) is a person who is engaged in driving a BSP car.
On November 5, 2017, the Defendant driven the said car under the influence of alcohol content of 0.140% in blood around 02:53 on November 5, 2017, and continued to proceed from the middle school towards the middle school located in the direction of the 498 decentralization in Sungnam-si.
At the time, there are vehicles that are different from the signal crossings at the front of the Defendant’s running direction, so in such cases, the driver of the vehicle has a duty of care to maintain the safety distance with the prior vehicle, properly operate the brakes, and prevent the accident in advance.
Nevertheless, the Defendant neglected to do so and led the victim C (60 years old) who stops at the intersection signal atmosphere due to negligence, thereby driving the back end of the SP car at DNA, and caused the above SP car to be driven by the front end of the SP car, and due to the shock, the victim E (34 years old) who stops in the signal atmosphere at the front end of the SP car, and caused the back end of the FP sports car driven by the victim E (34 years old).
Ultimately, the Defendant suffered from the injury, such as the victim C, the passenger car car G (V, 56 years old), and the victim E, with approximately two weeks of medical treatment due to the above occupational negligence.
