[Defendant A] Defendant A is punished by imprisonment with prison labor for eight months.
Defendant
A Nos. 3 and 12 shall be confiscated.
Reasons
Punishment of the crime
1. Defendant A
A. (1) On July 2014, the Defendant: (a) taken a passbook, cash card, OTP card, etc. from F to F in the “E” coffee shop located in Seongbuk-gu, Seongbuk-gu, Sungnam-gu; and (b) 200,000 won to F in consideration of the price.
2) On September 2014, the Defendant: (a) opened a passbook, cash card, OTP card, etc. from F to the national bank account (Account Number: H) in the “E” coffee shop located in Seongbuk-gu, Seongbuk-gu, Sungnam-gu; and (b) opened the F with a consideration of KRW 200,000,000 to F.
3) On November 2014, the Defendant: (a) at a coffee shop located near the behavioral branch, the 486 National Bank opened a passbook, cash card, OTP card, etc. from I to the national bank account in its name; and (b) provided I with KRW 500,000 as a consideration therefor.
4) On January 2016, the Defendant: (a) obtained a passbook, cash card, OTP card, etc. from I for a national bank account in his/her name in the name of the National Bank account (K) on the roads near the Han Man-gu, Sungnam-gu, Sung-gu; and (b) 80,000 won, as a consideration, to I.
5) On September 2016, 2016, the Defendant: (a) opened a passbook, cash card, and an OTP card from B on the front of “M,” located in Sungnam-si L, Sungnam-si; (b) opened the passbook, cash card, and the OTP card from B; and (c) opened KRW 600,000,000 for the consideration thereof to B.
6) On January 1, 2017, the Defendant: (a) opened a passbook, cash card, and OTP card from B in the name of a new bank account (O: the account number) on the road in front of the 553 G University, Sungnam-si, Sungnam-si; and (b) opened KRW 600,000 for the consideration thereof to B.
Accordingly, the Defendant acquired the access media over six times.
B. The Defendant in violation of the National Sports Promotion Act (replacement, etc. of gambling) committed by the Defendant in collusion with P (Detention Prosecution on January 3, 2017), Q, R (Detention Prosecution on January 5, 2017), S, and T. From May 2012 to September 2016.
