1. The Defendant’s KRW 7,727,50 and the Plaintiff’s KRW 20% per annum from September 1, 2015 to September 30, 2015.
Reasons
1. From September 2, 2014 to April 8, 2015, the Plaintiff claiming the payment of interest and the total amount of loans lent to the Defendant without an agreement on the due date, KRW 49,227,50, the principal of which was unpaid, KRW 727,500, and the damages for delay thereof.
2. Applicable provisions of Acts: Article 208 (3) 1 of the Civil Procedure Act;
3. Partial dismissed portion: The damages for delay shall be dismissed, recognizing only the damages for delay calculated at the rate of 15% per annum from October 1, 2015 pursuant to the provisions on statutory interest rate under the main sentence of Article 3 (1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 26553, Oct. 1, 2015).
