A. Defendant Forest Development Co., Ltd. (hereinafter “Defendant Forest Development”) concluded a loan agreement with the Korea Savings Bank Co., Ltd. (hereinafter “Korea Savings Bank”), the Gyeonggi Savings Bank Co., Ltd. (hereinafter “Korea Savings Bank”), the Gyeonggi Savings Bank Co., Ltd. (hereinafter “K Savings Bank”), and the Yongnam Savings Bank Co., Ltd. (hereinafter “Ynam Savings Bank”), to lend KRW 12,00,000,000 (hereinafter “instant initial loan agreement”) to secure all debts owed by Defendant Forest Development to the lender pursuant to the above agreement, etc., and agreed to conclude a real estate trust agreement with respect to the land in this case in order to secure all debts owed by Defendant Forest Development to the lender pursuant to the above agreement, etc., and to deliver a certificate of beneficial interest to the lender.

(hereinafter “Plaintiff One Assets Trust”) as the trustee on December 6, 2010, for the land outside 8,409 square meters in the instant project site, the Plaintiff as the trustee; on the same day, Eul concluded a real estate security trust contract with respect to the land outside 871 square meters and 10 square meters in the relevant land for the said Plaintiff as the trustee; on May 6, 2010, Defendant Wood Forest Development concluded a real estate security trust contract with the said Plaintiff as the trustee on May 6, 2010 on the same day with respect to the land outside 8,409 square meters in the relevant trust contract for each of the instant land (hereinafter “the instant trust contract’s comprehensive trust agreement, and each of the instant trust contracts’ joint property”).
