Reasons
1. Basic facts
A. C Co., Ltd. (hereinafter “C”) is a construction project for newly constructing and selling E apartment units (hereinafter “instant apartment units”) with a scale of 1,304 units on the ground of 52,672,00 square meters in Young-gu in Incheon Metropolitan City (hereinafter “In Mancheon-si”), which is a multi-family housing of 12 households, on the ground of 52,672,000 square meters in the Young-gu in the free economic zone (hereinafter “Seoul”), and the Asian Art Investment Development Co., Ltd. (hereinafter “instant apartment units”) is the executor of the foregoing business, and the Korea Asset Trust Co., Ltd. (hereinafter “asset Trust”) is a trustee entrusted with the instant apartment construction project, the sales project, etc., by proxy, from the main development.
B. From January 2010 to February 2010, the Plaintiffs concluded a sales contract and an intermediate payment loan agreement between the Plaintiffs and the Defendant (i) between the assets trust and the assets trust, respectively, that the Plaintiff Party A would sell the instant apartment units at KRW 239,30,000, and the Plaintiff B would sell the instant apartment units at KRW 253,20,000, respectively, with the sales price of KRW 1401, the sales contract between the Plaintiff and the Defendant (hereinafter “instant sales contract”).
