Reasons
Punishment of the crime
On June 14, 2019, the Defendant was sentenced to one year of imprisonment and two years of suspended execution by the Jeonju District Court for violating the Act on Special Cases Concerning the Settlement of Traffic Accidents, etc., and the judgment became final and conclusive on the 22th day of the same month, and operated the “D” in the B apartment in the followingsan City, and managed the above subparagraphs c and e.
At around 16:20 on December 29, 2016, the Defendant had been engaged in the work of removing liquefied petroleum gas (LPG) pipelines installed therein. In such a case, the Defendant, as a manager of liquefied petroleum gas piping, was responsible for the safety management of gas-using facilities, and thus, the Defendant was obliged to thoroughly prevent gas leakage by requesting a gas facility construction business operator to remove pipes for safety purposes or by preventing gas explosion or leakage if he/she had been removed by a non-gas facility construction business operator.
Nevertheless, the Defendant, without taking any measures necessary for the prevention of gas leakage such as locking off the middle valve, cut the pipelines of liquefied petroleum gas into hand, and cut it out by the glars where it is impossible to identify liquefied petroleum gas leaked, thereby explosioning by the victim F, thereby damaging them so that the amount equivalent to KRW 14,168,040 as repair expenses such as the signboards and outer walls of the second floor church of the above commercial building managed by the victim F. The amount equivalent to KRW 11,827,250 as repair expenses for the signboards and walls of the above commercial building managed by the victim G. The amount equivalent to KRW 11,827,250 as repair expenses, such as the signboards and walls of the victim H association of the first floor of the commercial building managed by the victim G. Accordingly, the defendant caused danger to human life, body or property by burning explosive objects by negligence.
