1. Facts of recognition;

A. On August 31, 1981, the registration of ownership preservation was completed in accordance with the Act on Special Measures for the Registration, etc. of Real Estate Ownership due to the sharing of D, E, and F, which is the ground of the Plaintiff’s clans D, E, and F. The registration of ownership preservation was completed on August 31, 1981.

After that, on January 3, 2012, D's 1/3 of land among land C, the registration of ownership transfer was completed due to inheritance due to a consultation division in the name of G on January 3, 2012, and on January 3, 2012, the registration of ownership transfer was completed due to the cancellation of title trust in the name of the Plaintiff on the same day.

In addition, on February 16, 2012 for E-1/3 of land, the registration of ownership transfer due to inheritance due to the consultation division in H name on February 16, 2012 for E-1/3 of land, and the registration of ownership transfer due to inheritance due to the consultation division in the name of F on May 25, 2012 for F-1/3 of land.

The Defendant owns a block-structureed stone roof building (hereinafter “instant building”) located on the ground of 13, 14, 15, 16, 17, 18, 19, 20, 22, 22, 23, 7, 8, 11, 10, 12, and 13, which are located on the following grounds: (a) the part of “bbb” in the attached drawings among the land C and the part of “bb” in the area adjacent to the said part of “J-gun, Gyeongnam-gun, Busan Metropolitan City (hereinafter “J land”).
