A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant, a person who operated a mobile phone agency in B with the trade name of “C agency” in Chungcheongnam-nam, used the mobile phone of D visiting the said C agency to replace the mobile phone and deliver the resident registration certificate, etc., and arbitrarily opened the mobile phone without permission, thereby raising profits from the telecommunications company.

1. Crimes committed on May 29, 2017;

A. On May 29, 2017, the Defendant, such as a private electronic record, applied for the opening of a mobile phone with the cell phone number “E” using the table PC for joining the mobile phone at the foregoing C agency, and entered the name of “E”, “application for a new service contract”, “application for a selective contract discount system”, and “a short-term transaction contract” into the name of “D”, and signed arbitrarily on the next page.

As a result, for the purpose of facilitating the management of affairs, the Defendant formulated the "new service contract", "application for subscription to the selective contract discount system", and "short-term transaction contract", which are electronic records of others with respect to rights and obligations.

B. In the event, such as electronic records of the above author, the Defendant exercised the following methods: (a) “new service contract”, “application for selective agreement discount”, and “shortend sales contract”, which were written in paragraph (1) at the time and place specified in paragraph (1) of the above Article 1, by transmitting the “nameless SK Telecom staff” as if they were genuinely formed.

2. Crimes committed on June 28, 2017;

A. On June 28, 2017, the Defendant entered “A810” in the part of the model name of “A810”, “153,300 won” in the part of “A83,300”, and signed “D” in the part of “BD Data 1.2” in the part of the title of “F”, “F”, and mobile phone information” in the part of “B”, “F”, “A810”, and “a53,300 won” in the part of the name of “B”.
