Defendant shall be punished by a fine of KRW 1,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The defendant of "2015 High 175" is the actual representative of C&A in Cheongbuk-do, Chungcheongnam-do, who is an employer who runs an agricultural business with 17 full-time workers.

1. When a worker dies or retires, the employer shall pay the wages, accident compensations, and all other money and valuables within fourteen days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant worked from January 1, 2009 at the above workplace and did not pay 18,189,620 won in total for seven retired workers as well as 1,328,795 won on January 1, 2014 of D’s retired workers on June 1, 2014 as well as 18,189,620 won in the attached Table (1) as in the crime list.

2. When a worker retires, the employer shall pay the retirement allowance within fourteen days after the cause for such payment occurred; and

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant, while working from January 1, 2009 at the above workplace, did not pay KRW 7,246,538 of the retirement allowance of retired workers D on June 1, 2014 within 14 days from the date of retirement where the cause for the payment occurred without agreement between the parties on the extension of the due date.

The defendant of "2015 High 1349" is the actual representative of the Cagricultural partnership in Cheongbuk-do, Chungcheongnam-do, who is an employer who runs an agricultural (crops) by using ten full-time workers.

1. When a worker dies or retires, the employer shall pay the wages, accident compensations, and all other money and valuables within fourteen days after the cause for such payment occurred;

Provided, That if there are special circumstances, the agreement between the parties shall be reached.
