1. The Defendants are each corresponding money indicated in the “sale price” list of the details of the execution of the attached sales contract from the Plaintiff.
Reasons
Basic Facts
On January 20, 201, the Namyang-si Mayor designated the 39,145 square meters (hereinafter referred to as the “instant business area”) of O Il-si, Namyang-si as a housing reconstruction improvement zone A (P apartment).
The Plaintiff (hereinafter referred to as the “Plaintiff Association”) obtained authorization to establish a new apartment on December 29, 201 for a reconstruction project to remove the Past apartment in the instant project zone and build a new apartment on the ground. The Plaintiff (hereinafter referred to as the “Plaintiff Association”) is a reconstruction association which completed the registration of establishment on January 12, 2012, and the Defendants are the owners of each real estate listed in the separate sheet in the instant project zone.
Plaintiff
On August 2012, a union notified the Defendants to consent to the establishment of the Plaintiff union, but the Defendants did not reply to the Plaintiff union. Accordingly, the Plaintiff union notified the Defendants to join the Plaintiff union by serving a duplicate of the complaint of this case. The Plaintiff union may request the Plaintiff union to sell the land or building ownership and other rights at the market price as it did not consent if it did not reply within two months from the date of receipt of the duplicate of the complaint of this case. The purport that the Defendants may request the Plaintiff union to sell the land or building at the market price on the condition that the Defendants do not join the Plaintiff union (hereinafter “Urban Improvement Act”), Article 39 of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “Urban Improvement Act”), Article 48 of the Act on the Ownership and Management of Aggregate Buildings (hereinafter “the Act”), and the purport that the Defendants exercise their right to demand sale under the Article 39 of the Act on the Maintenance and Improvement of Urban Areas and Dwelling Conditions for Residents (hereinafter “the Act”).
