1. The Plaintiff:
A. Defendant B apartment rearrangement project association: (a) KRW 2,809,966,342 and its related amount from May 1, 2015 to November 2017.
Reasons
1. Basic facts
A. With respect to the parties, the Plaintiff is an organization comprised of representatives from each Dong residents elected by each Dong residents of the 30-dong A apartment-dong 1,522 households of Changwon-si, Changwon-si (hereinafter “the apartment of this case”).
Defendant B Apartment Rearrangement Project Association (hereinafter “Defendant Association”) is a project proprietor who newly built the instant apartment and sold it to each sectional owner. Defendant C Co., Ltd. (hereinafter “Defendant C”) is a Si Corporation to place the instant apartment in accordance with the contract with the Defendant Association, and Defendant Korea Housing and Urban Guarantee Corporation (hereinafter “Defendant Corporation”) was a corporation that operated the Housing and Urban Fund in accordance with the Housing and Urban Fund Act to provide various kinds of guarantee services, etc. with the financial resources.
B. On June 15, 2010, the apartment of this case, which entered into the construction completion of the apartment of this case and the warranty contract for the repair of defects, obtained approval from the head of the Gu of Changwon-si.
On September 29, 2011, Defendant C entered into a warranty contract with Defendant C to guarantee the obligation to repair defects in relation to the instant apartment (hereinafter “instant warranty contract”) and issued a warranty bond with the content that the respective warranty period and the annual rent (referring to the number of years elapsed from the date of conclusion of the instant warranty contract) to the extent of the amount stated below.
