Reasons
Punishment of the crime
1. The victim of occupational embezzlement victim D (hereinafter “victim”) is a company established mainly for the processing and selling of livestock products. The Defendant is a representative of “F”, a branch of the victim company located in Heung-gu, Gyeonggi-do from January 2013 to March 2014, who was supplied with livestock products from the victim company and sold and received them to the customer company, and was engaged in the business of depositing in the victim company. The Defendant supplied livestock products to “G”, which is a customer, from February 13, 2013 to October 2, 2013, and received KRW 28,038,020 as the price of the goods from the account in the name of the Defendant and kept it for the victim company. The Defendant deposited only KRW 7,636,370 out of the price of the said goods into the account in the name of the victim company, and used the remaining KRW 20,401,650 on his/her own discretion as the repayment of his/her personal debt around that time.
B. From June 5, 2013 to March 17, 2014, the Defendant supplied livestock products to “H”, which is a business partner, and then deposited KRW 222,235,370 as the account in the name of the Defendant, and deposited KRW 202,581,940 in the account of the victim’s company, and deposited only KRW 202,581,940 in the account of the victim’s company as the business partner, and used the remainder KRW 19,653,430 in the account of the victim’s company at will around that time.
C. On September 9, 2013, from around March 7, 2014 to around March 7, 2014, the Defendant supplied livestock products to “I”, which is a customer, and deposited KRW 57,906,80 in the account under the name of the Defendant, and deposited KRW 42,00,000 in the account of the victim company in the name of the victim company and used the remainder KRW 15,906,80 in the account of the victim company.
The Defendant supplied livestock products to the “J”, which is a business partner, from October 2, 2013 to January 23, 2014, and received KRW 49,74,750 as the amount of the goods from the account in the name of the Defendant.
