A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On October 30, 2014, the Defendant was sentenced to six months of imprisonment for a crime of fraud in the Sungwon District Court's Sungnam branch on March 27, 2015, and the sentence becomes final and conclusive.

On November 28, 2013, the Defendant entered into a lease contract on the condition that the annual interest rate for C 2014-type Aridia7 car volume owned by the victim C 2014-type 19% per month shall be 19% per annum from the 54th 4th 4th Do-ro, Seoul, as the distribution of Seocho-gu Seoul Metropolitan Government.

The Defendant, while using the foregoing vehicle and keeping the vehicle for the victim, was in arrears with the monthly rent that should be paid every month from April 2014, and embezzled the said vehicle by means of refusing to return the vehicle and concealing the vehicle, despite the victim’s demand for termination of the lease contract and return of the vehicle pursuant to the lease agreement, around May 9, 2014.

around March 17, 2014, the Defendant entered into a lease agreement with the condition that the vehicle value of 61,900,000 won per month shall be paid at the victim Hyundai Capital Co., Ltd. at the point of the party branch located in Seongbuk-si 176, Sungnam-si, Sungnam-si, 176, and the vehicle value of 61,90,000 won per month during the period from March 17, 2014 to March 17, 2018.

While the Defendant used the said vehicle and stored the said vehicle for the victim, the monthly rent is overdue, which should be paid every month from July 2014, and was requested by the victim to terminate the lease contract and to return the vehicle in accordance with the lease agreement on September 18, 2014, the Defendant embezzled the said vehicle by refusing to return the vehicle, refusing to return the vehicle, and concealing it in an unclaimed place.
