Reasons
Indictment
1. In the case of Defendant A who recorded the false statement in the original of a notarial deed, Defendant A is a member of the H church conference held in Ulsan-gu G; Defendant B is a member of the same church finance committee; Defendant C is a member of the same church property management committee; Defendant C is a member of the same church property management committee; and Defendant D is a member of the same church education committee.
In selling the land and the three-story building owned by the above HH association, the Defendants concluded a sales contract with the content of selling the above old company housing to the purchaser J around October 7, 201, on the basis of the resolution of the joint council, although the above church's articles of association or other rules do not exist to dispose of the real estate owned by the church, the Defendants decided to sell the above old company housing only by the resolution of the party council without the resolution of the joint council, and entered into a sales contract with the content of selling the above old company housing to the purchaser J to 39 million won.
On December 6, 2011, the Defendants arbitrarily prepared the church rules stating that the above church rules do not exist with respect to the disposal of real property, but the management of the church property shall be conducted at the church meeting; after signing the name of Defendant A at the bottom, affixed the seal of the church; and on December 4, 2011, even though the church meeting was not held on December 4, 201, there was a resolution of the church meeting stating that the above real property shall be sold at the church meeting of the above members at the church meeting of the above members on December 4, 2011, the Defendants prepared the minutes of the meeting; and submitted the above documents to the certified judicial scrivener through the KK's house, who was in charge of the above church affairs with the name and seal affixed by the members of the above members, and had the public official in charge submit the above documents to the public official in charge of the above sales contract, the church rules, and the minutes of the meeting, and had the public official in charge of the above real property registered the ownership transfer on the ground of the above sale contract on October 17, 2010.
