A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the above sentence shall be executed for one year and six months from the date this judgment becomes final and conclusive.

Criminal facts

On March 2019, the Defendant: (a) received a proposal from sexual French C, which was known as a result of the introduction of sexual French B, and (b) intended to establish a passbook in the name of a stock company and to establish a passbook in the name of a stock company by actually establishing a stock company and distribute the passbook; (c) although the Defendant did not have paid the capital, the Defendant conspiredd to establish a nameless person and so-called “the old-age corporation” as introduced by the above sexual French C and sexual French C to assist the Defendant in the establishment of a corporation.

1. On April 1, 2019, according to the above public offering, the Defendant violated the Commercial Act deposited KRW 1 million in cash, which was received from an unqualified person in his name in the name of the Defendant’s post office account (E) in the name of the Defendant, and received a certificate of deposit balance, and used it for the establishment of the corporation thereafter. On April 2, 2019, the Defendant withdrawn one million won in cash, which was deposited as above, and returned to the above person under his name.

Accordingly, the defendant pretended to pay shares in collusion with sex C and the person with no name.

In accordance with the above public offering, the Defendant: (a) at early April 2019, entered the public electronic records, etc., the Defendant: (b) opened a balance certificate, resident registration certificate, seal imprint, and certificate of personal seal impression in the name of the Defendant necessary for the establishment of a juristic person to the name poor person; and (c) the above name poor person F, a certified judicial scrivener F, who is entrusted the documents to the certified judicial scrivenerF, applied for the registration of the establishment of a juristic person with the content of “mutual name D, Ga, H, Ha, and 100 won, total number of shares to be issued, 100,000 won, total amount of capital stock, 1,000,000 won, e-commerce business, clothes, and miscellaneous retail business, and all incidental businesses related to each subparagraph.”
