A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
From April 201 to October 201 of the same year, the Defendant lent a total of KRW 110,500,000 to the victim C (n, 46 years of age). However, on February 23, 2015, the victim C did not pay the principal and interest, resulting in the victim E (n, 44 years of age)’s failure to pay the principal and interest.
1. On February 23, 2015, the Defendant: (a) at the instant teahouse on February 23, 2015, on the grounds of the victim’s refusal to repay the victim’s debt to the victim C; (b) on the ground of the victim’s refusal, the Defendant marked the part of the victim’s left shoulder; (c) marked the victim’s stick to the victim’s left shoulder; (d) displayed the above stick to the victim E, carried the victim’s left hand and shoulder; and (e) carried the part of the victim E with the above stick; (e) continuously carried the victim’s head and left part of the victim’s head and left part; and (e) put the victim’s part on the right side of the victim E with drinking.
Accordingly, the defendant assaulted victims.
2. Violation of the Punishment of Violence, etc. Act (a collective action, deadly weapons, etc.) committed violence against the victims at the time, place, as mentioned in the above paragraph (1), and subsequently, the Defendant sounded kacknaf (21cc in total length, 10cc in daily length), which is a dangerous object prior to the victims of escape, to hand, and threatened the victims with the physical harm of the victims.
Accordingly, the defendant carried dangerous articles and threatened victims.
3. The Defendant causing property damage, at the date, time, place, as set forth in the above paragraph (1) above, shall set the stick in the above paragraph (1) above, and shall automatically open the door of the market price which is not owned by the victim E, such as three influences in the market price, and three influences and two influences and the door of the tea house, which are set up in front of the tea house.
