1. Of the instant lawsuit, the Defendant’s construction permit indicated in the [Attachment 1] Nos. 1 and 5 of the reported details on January 10, 2018 was granted.
Reasons
1. Details of the disposition;
A. On November 14, 201, A Forest E Co., Ltd. obtained a building permit for the first class neighborhood living facilities for the land of the wife population E from the Defendant on November 14, 201. On December 16, 2011, the above owner’s name was changed to the Plaintiff. On August 7, 2012, the Plaintiff and B filed a building report for a detached house with the Defendant on the land of the wife population F or G (hereinafter collectively referred to as “each of the instant lands”) or obtained a building permit for the first class neighborhood living facilities from the Defendant. The details are as shown in the attached building permit and the details of the report.
B. The Plaintiff reported the commencement of construction in relation to the building permit or building report on part of each of the instant lands, and partially implemented the cut and civil construction works (hereinafter “the instant structure”). However, each of the instant lands was awarded a successful bid in Suwon District Court H and I (Dupl) on November 28, 2017, and acquired the ownership of each of the instant land by completely paying the sale price on December 14, 2017.
C. On December 15, 2017, C and D submitted to the Defendant a written decision on permission to sell each of the instant land, a certificate of full payment of sale price, an appraisal report, a written opinion of review by an attorney-at-law, etc., to change the construction participants attached thereto. On January 10, 2018, the Defendant accepted each change of the construction participants’ name on each construction permit and report entered in the attached Form 1 building permit and the details of the report, as stated in C and D’s “Amended owner” column for the construction permit and the details of the report.
